Withdrawn Theft Charge Still Shows Up on Criminal Background Check By Gerald @ Pardons Pardon/Record SuspensionOctober 31, 2019Edited by Admin0 Back to Home Visitor: My theft charge was withdrawn in court the other day, does that mean dismissed? I want to start working with Uber and when they did my background check it wasn’t approved. They said there was something showing up on the criminal background check. I don’t understand why considering my offence was withdrawn which I think means “not guilty”. Pardons Canada: If your theft charge was withdrawn it is different than dismissed but has the same effect in that you were not convicted of a criminal offence which is the good news. However, because you were fingerprinted and photographed by the police, your information is still in the police and RCMP database. This is a shock to many people as they assumed that because their charge was dismissed, withdrawn, stayed, peace bond, diversion or discharged that it would all disappear. Unfortunately that is not the case as you can see when you applied for a job with Uber. Pardons Canada: The good news is that you can make an application to remove your prints and photographs by way of a file destruction with the police and RCMP. Once this is approved, you will be safe to apply to Uber and other jobs as your theft charge will no longer show up on a criminal background check.
