Removing a DUI that was Withdrawn or Dismissed

Visitor:  I recently just got my criminal record check done and I see it’s still says I was charged with a DUI.  I dealt with that so I don’t know why since it was dismissed in court and I was never charged I was just wondering why would it still be on my criminal record?

Pardons Canada:  It is rare to get a DUI or Impaired Driving charge withdrawn or dismissed so it is good that you did not get a criminal conviction. However, because you were fingerprinted by the police it still shows up in a criminal check that you were in trouble with the police.  Once a file destruction is approved by the RCMP and police then is will no longer show up on a criminal background check.  If your offence was stayed, peace bond or conditional discharge or absolute discharge then you still require a file destruction to remove the prints even though you were not convicted.
