I had stolen 1 backpack, 1 t-shirt and 3 necklaces with a total estimated value of $271. I cooperated with the authorities and pleaded guilty to two counts: the first charge was for theft under $5000, and the second was for possession of stolen goods knowing that some or all of them were obtained and were commissioned in Canada. In June 2009, I was given an absolute discharge for the first charge, and there was a conditional discharge of the procedures on the second charge. Unfortunately, despite being absolved of this crime, the results of my past actions continue to live with me. On June 9th, 2018, I was applying for a TN visa to work at Apple Inc. in California as a Graphic Designer. At the time, my TN visa application was denied, I was told, because of my previous shoplifting charge. I showed the border officials my court records but unfortunately my application was still denied and I was told I need to apply for a waiver to enter the U.S. Pardons Canada: Even though you received a conditional discharge, the Americans can see that you were fingerprinted by the police for a theft offence and they have denied your TN visa. This does not necessarily mean you require a US Entry Waiver or I-194 unless they actually denied you entry at the border and fingerprinted you.
