The timing for obtaining a pardon or record suspension will depend on the outcome in court. For summary offences, you must be out of trouble for five years from the end of your punishment. For indictable offences, you must be out of trouble for ten years from the end of your punishment. Make sure that all your fines have been paid as well. Summary offences are considered more minor offences like DUI, theft under, assault, and fraud under 5000. Indictable offences are considered more serious offences such as fraud over 5000, drug trafficking, assault causing bodily harm, theft over 5000. The process for obtaining a pardon or record suspension takes some time as we need to gather and prepare all of the original legal forms including court records and RCMP files. Since the process takes time, you may start your file before your eligibility date with Pardons Canada and then we will ensure all of the paperwork gathered and the application filled out properly so that we can submit it to the federal government on your eligibility date.
